This document outlines the limitations of liability and disclaimers applicable to Retail Store Aid (Pty) Ltd services. Please read this carefully to understand our obligations and your responsibilities.

Services Provided "As Is"

Retail Store Aid (Pty) Ltd provides services as described in quotations and agreements. All services are provided on an "as is" basis without further warranties beyond those explicitly stated in writing. We endeavor to meet industry standards and maintain quality workmanship, but all work is subject to the terms and conditions outlined in our formal service agreements.

What We Are Not Responsible For

Retail Store Aid (Pty) Ltd is NOT responsible for the following circumstances, conditions, or outcomes:

Structural Issues

  • Pre-existing structural defects discovered during work
  • Foundation problems, settling, or cracking not caused by Retail Store Aid
  • Hidden damage in existing structures or underlying materials
  • Asbestos or other hazardous materials not disclosed prior to commencement
  • Structural integrity concerns arising from previous renovations or alterations

Materials & Specifications

  • Client-supplied materials or defective materials provided by client
  • Quality or durability of materials selected by client without our recommendation
  • Performance of materials beyond Retail Store Aid's control or knowledge
  • Compatibility issues between client-selected materials and existing infrastructure
  • Non-standard or specialist materials requiring manufacturer warranties

External Factors

  • Weather delays and weather-related damage to completed or in-progress work
  • Supplier delays in material delivery or manufacturing
  • Third-party contractor performance or quality issues
  • Utility provider interruptions (water, electricity, gas, sewage)
  • Acts of God, natural disasters, or unforeseen circumstances beyond reasonable control
  • Changes in legislation, building codes, or regulatory requirements during project execution

Limitation of Liability

Retail Store Aid (Pty) Ltd's total liability under any contract, agreement, or claim arising from services provided shall be limited to the total contract value or the cost of repair, whichever is less. In no event shall Retail Store Aid be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunity
  • Damage to personal property or third-party claims
  • Punitive or exemplary damages
  • Costs associated with project delays beyond our direct control

These limitations apply regardless of whether liability arises from breach of contract, negligence, or any other legal theory, except where prohibited by law.

Client Responsibilities & Obligations

By engaging Retail Store Aid (Pty) Ltd, the client acknowledges and agrees to the following responsibilities:

  1. Site Access & Preparation: Ensure the work site is accessible, clear of obstructions, and prepared according to our specifications
  2. Utility Disclosure: Disclose the location and status of all utilities (water, electricity, gas, sewage) before work commences
  3. Material Approval: Approve all materials, specifications, and design plans in writing before commencement
  4. Third-Party Coordination: Coordinate with other contractors, service providers, or occupants to minimize conflicts
  5. Hazardous Material Disclosure: Immediately disclose any known hazardous materials, mold, or environmental concerns
  6. Permits & Approvals: Obtain all necessary permits, council approvals, and regulatory clearances where applicable
  7. Payment Terms: Maintain payment schedules as agreed; work may be suspended for non-payment
  8. Insurance: Maintain adequate property and liability insurance during project execution

Dispute Resolution & Jurisdiction

Any disputes arising from services provided or contractual obligations shall be resolved as follows:

  • Negotiation: Parties shall attempt to resolve disputes through good-faith negotiation within 14 business days
  • Mediation: If negotiation fails, disputes may be referred to mediation at a mutually agreed location
  • Arbitration/Litigation: Unresolved disputes shall be subject to the laws of the Republic of South Africa and jurisdiction of competent courts in KwaZulu-Natal
  • Notice Requirements: Any claim must be submitted in writing within 30 days of the alleged breach or defect

Retail Store Aid (Pty) Ltd reserves the right to take legal action to enforce payment or recover damages resulting from client breach of contract or non-payment.

Warranty Exclusions

Retail Store Aid (Pty) Ltd does NOT provide warranties beyond those explicitly stated in written agreements. Specifically:

  • No warranty of merchantability or fitness for a particular purpose
  • No warranty that services will be uninterrupted or error-free
  • No warranty on materials or products supplied by third parties or manufacturers
  • No warranty extending beyond the defects liability period specified in the contract
  • Warranties are void if work is altered, modified, or maintained improperly by third parties
